THE MATERNITY BENEFITS ACT, 1961 BY SUSHMA SUDHINDRA 1. OBJECTIVE To regulate the employment of women in certain establishment for certain period before and after child-birth and to provide for maternity benefit and certain other benefits. To provide healthy maintenance of pregnant women employee and her child 2. APPLICABILITY Every factory, mine or plantation(including those belonging to Government) To every shop or establishment wherein 10 or more persons are employed 3. TERMS OF EMPLOYMENT No employer shall knowingly employ a woman in any establishment during the 6 weeks immediately following the day of her delivery or her miscarriage. No woman shall work in any establishment during the 6 weeks immediately following the day of her delivery or her miscarriage. No pregnant woman shall, on a request being made by her in this behalf, be required by her employer to do any work which is of an arduous nature or which involves long hours of standing or which in any way is likely to interfere with her pregnancy or the normal development of the foetus, or is likely to cause her miscarriage or otherwise to adversely affect her health. The period referred to in sub-section (3) shall be – (a) at the period of 1 month immediately preceding the period of 6 weeks, before the date of her expected delivery; (b) any period during the said period of 6 weeks for which the pregnant woman does not avail of leave of absence. 4. PAYMENT OF THE MATERNITY BENEFITS Every woman shall be entitled to, and her employer shall be liable for, the payment of maternity benefit at the rate of the average daily wage for the period of her actual absence i. . immediately preceding and including the day of her delivery and any period following that day. The average daily wage means the average of the woman's wages payable to her for the days on which she has worked during the period of 3 calendar months immediately preceding the date from which she absents herself on account of maternity, [the minimum rate of wage fixed or revised under the Minimum Wages Act, 1948 (11 of 1948) or ten rupees, whichever is the highest]. PAYMENT OF THE MATERNITY BENEFITS No woman shall be entitled to maternity benefit unless she has actually worked in an establishment of the employer from whom she claims maternity benefit, for a period of not less than 80 days in the 12 months immediately preceding the date of her expected delivery provided that the qualifying period of 80 days aforesaid shall not apply to a woman who has immigrated into the State of Assam and was pregnant at the time of the immigration. For the purpose of calculating under the sub-section the days on which a woman has actually worked in the establishment [the days for which she has been laid off or was on holidays declared under any law for the time being in force to be holidays with wages] during the period of 12 months immediately preceding the date of her expected delivery shall be taken into account. PAYMENT OF THE MATERNITY BENEFITS The maximum period for which any woman shall be entitled to maternity benefit shall be 12 weeks of which not more than 6 weeks shall precede the date of her expected delivery provided that where a woman dies during this period, the maternity benefit shall be payable only for the days up to and including the day of her death: Provided further that where a woman, having been delivered of a child, dies during her delivery or during the period immediately following the date of her delivery for which she is entitled for the maternity benefit, leaving behind in either case the child, the employer shall be liable for the maternity benefit for that entire period but if the child also dies during the said period, then, for the days up to and including the date of the death of the child. 5. CONDITIONS FOR CLAIMING BENEFITS Must actually work for 80 days in 12 months immediately preceding her date of Delivery. Should intimate the employer 7 weeks before her delivery date about the leave period. Can take advance payment for 6 week leave before delivery Can take payment for 6 week leave after child birth within 48 hours after submitting the proof. 6. PAYMENT IN CASE OF DEATH OF THE WOMAN If a woman entitled to maternity benefit or any other amount under this Act, dies before receiving such maternity benefit or amount, or where the employer is liable for maternity benefit , the employer shall pay such benefit or amount to the person nominated by the woman in the notice given and in case there is no such nominee, to her legal representative. 7. PAYMENT OF MEDICAL BONUS Every woman entitled to maternity benefit under this act shall also be entitled to receive from her employer a medical bonus of 25 rupees, if no pre-natal confinement and postnatal care is provided for by the employer free of charge. 8. LEAVE FOR MISCARRIAGE In case of miscarriage, a woman shall, on production of such proof as may be prescribed, be entitled to leave with wages at the rate of maternity benefit for a period of 6 weeks immediately following the day of her miscarriage. 9. LEAVE FOR ILLNESS ARISING OUT OF PREGNANCY, DELIVERY, PREMATURE BIRTH OF CHILD, OR MISCARRIAGE A woman suffering illness arising out of pregnancy, delivery, premature birth of child or miscarriage shall, on production of such proof as may be prescribed, be entitled in addition to the period of absence allowed to her under section 6, or, as the case may be, under section 9, to leave with wages at the rate of maternity benefit for a maximum period of 1 month. 10. NURSING BREAKS Every woman delivered of a child who returns to duty after such delivery shall, in addition to the interval for rest allowed to her, be allowed in the course of her daily work 2 breaks of the prescribed duration for nursing the child until the child attains the age of 15 months. 11. DISMISSAL DURING ABSENSE OR PREGNANCY (1) Where a woman absents herself from work in accordance with the provisions of this Act, it shall be unlawful for her employer to discharge or dismiss her during or on account of such absence or to give notice of discharge or dismissal on such a day that the notice will expire during such absence, or to vary to her disadvantage any of the conditions of her service. 2) (a) The discharge or dismissal of a woman at any time during her pregnancy, if the woman but for such discharge of dismissal would have been entitled to maternity benefit or medical bonus referred to in section 8, shall not have the effect of depriving her of the maternity benefit or medical bonus: Pro vided that where the dismissal is for any prescribed gross misconduct the employer may, by order in writing communicated to the woman, deprive her of the maternity benefit or medical bonus or both. (b) Any woman deprived of maternity benefit or medical bonus or both may, within sixty days from the date on which the order of such deprivation is communicated to her, appeal to such authority as may be prescribed, and the decision of that authority on such appeal, whether the woman should or should not be deprived of maternity benefits or medical bonus or both, shall be final. (c) Nothing contained in this sub-section shall affect the provisions contained in subsection(1). 12. NO DEDUCTION OF WAGES IN CERTAIN CASES No deduction from the normal and usual daily wages of a woman entitled to maternity benefit under the provisions of this Act shall be made by reason only of – (a) the nature of work assigned to her by virtue of the provisions contained in subsection (3) of section 4 : or (b) breaks for nursing the child allowed to her under the provisions of section 11. 13. APPOINTMENT OF INSPECTORS The appropriate Government may, by notification in the Official Gazette, appoint such officers as it thinks fit to by Inspectors for the purposes of this Act and may define the local limits of the jurisdiction within which they shall exercise their function under this Act. 14. POWERS AND DUTIES OF INSPECTORS An Inspector may, subject to such restrictions or conditions as may be prescribed, exercise all or any of the following powers, namely: (a) enter at all reasonable times with such assistants, if any, being persons in the service of the Government or any local or other public authority as he thinks fit, any premises or place where women are employed or work is given to them in an establishment, for the purposes or examining any registers, records and notices required to be kept or exhibited by or under this Act and require their production for inspection; (b) examine any person whom he finds in any premises or place and who, he has reasonable cause to believe, is employed in the establishment: Provided that no person shall be compelled under this section to answer any question or give any evidence tending to incriminate himself: (c) require the employer to give information regarding the names and addresses of women employed, payments made to them, and applications or notices received from them under this Act; and (d) take copies of any registers and records or notices or any portions thereof. 15. POWER OF INSPECTOR TO DIRECT PAYMENTS TO BE MADE (1) Any woman claiming that maternity benefit or any other amount to which she is entitled under this Act and any person claiming that payment due under section 7 has been improperly withheld, may make a complaint to the inspector. 2) The Inspector may, of his own motion or on receipt of a complaint referred to in subsection (1), make an enquiry or cause an inquiry to be made and if satisfied that payment has been wrongfully withheld, may direct the payment to be made in accordance with his orders. (3) Any person aggrieved by the decision of the Inspector under sub-section (2) may, within thirty days from the date on which such decision is communicated to such person, appeal to the prescribed authority. (4) The decision of the prescribed authority where an appeal has been preferred to it under sub-section (3) or of the In spector where no such appeal has been preferred, shall be final. 5) Any amount payable under these sections shall be recoverable as an arrear of lane revenue. 16. FORFEITURE OF MATERNITY BENEFIT If a woman works in any establishment after she has been permitted by her employer to absent herself under the provisions of section 6 for any period during such authorized absence, he shall forfeit her claim to the maternity benefit for such period. 17. ABSTRACTS OF ACT AND RULES THERE UNDER TO BE EXHIBITED An abstract of the provisions of this Act and the rules made there under in the language or languages of the locality shall be exhibited in a conspicuous place by the employer in every part of the establishment in which women are employed. 18. REGISTERS, ETC. Every employer shall prepare and maintain such registers, records and muster-rolls and in such manner as may be prescribed. 19. PENALTY FOR CONTRAVENTION OF ACT BY EMPLOYERS If any employer contravenes the provisions of this Act or the rules made there under he shall be punishable with imprisonment which may extend to three months, or with fine which may extend to five hundred rupees, or with both; and where the contravention is of any provision regarding maternity benefit or regarding payment of any other amount and such maternity benefit or amount has not already been recovered, the court shall in addition recover such maternity benefit or amount as if it were a fine, and pay the same to the person entitled thereto. 20. PENALTY FOR OBSTRUCTING INSPECTOR Whoever fails to produce on demand by the Inspector any register or document in his custody kept in pursuance of this Act or the rules made there under or conceals or prevents any person from appearing before or being examined by an Inspector, shall be punishable with imprisonment which may extend to 3 months, or with fine which may extend to 500 rupees or with both. 21. PROTECTION OF ACTION TAKEN IN GOOD FAITH No suit, prosecution or other legal proceeding shall lie against any person for anything which is in good faith done or intended to be done in pursuance of this Act or of any rule or order made there under. 22. POWER OF CENTRAL GOVERNMENT TO GIVE DIRECTIONS The Central Government may give such directions as it may deem necessary to a State Government regarding the carrying into execution the provisions of this Act and the State Government shall comply with such directions. 23. EFFECT OF LAWS AND AGREEMENTS INCONSISTENT WITH THIS ACT (1) The provisions of this Act shall have effect notwithstanding anything inconsistent therewith contained in any other law or in the terms of any award, agreement or contract of service, whether made before or after the coming into force of this Act: Provided that where under any such award, agreement, contract of service or otherwise, a woman is entitled to benefits in respect of any matter which are more favourable to her than those to which she would be entitled under this Act, the woman shall continue to be entitled to the more favourable benefits in respect of that matter, notwithstanding that she is entitled to receive benefit in respect of other matters under this Act. (2) Nothing contained in this Act shall be construed to preclude a woman from entering into an agreement with her employer for granting her rights or privileges in respect of any matter, which are more favourable to her than those to which she would be en titled under this Act. This is because most farms use water that emanates from the system, and when they use fertilizers, it is highly possible that the remains will flow into the water system. This will cause pollution, making the water unsafe for human and animal consumption. Farmers also use insectides, and other house hold chemicals. It is important to find better ways of using the insecticides and chemicals (Wyatt et al, 32). There use must be in such a way, that it does not flow into the water system. After using them, it is important to dispose in an hazardous manner. By taking these measures a farmer will help in conserving the Aquifer system (Opie, 32). It is important for the Federal government and State government to to create policies and measures aimed at conserving the Aquifer. Whether it is relating to immigration laws, equal opportunity in schools and workplaces, or their role in government minorities are often a subject of controversy. Many citizens of the United States feel their ethnicities or sex are not fairly represented in Congress, the Justice system, or even in the Executive branch. Today we have an overwhelming majority of white males in Congress. Racial minorities and women alike are underrepresented in both houses. A debate continues on how to make this representation could become more equal. Some feel that the system is what it is and generally makes a level playing field for all candidates; others believe that white males are heavily favored in our current districting. Underrepresentation of minorities has been prevalent since the beginning of Americas government, and many feel that action must be taken to achieve a more representative Federal Government. Of all minorities, women are actually the weakest in representation. Women make up an equal amount of the United States total population, but they do not receive even close to half of the seats in Congress. In fact, as of this year, women only hold 19% of the seats in Congress. This number is record high, but is still very far from 50%. There are many factors contributing to womens underrepresentation in government. One is a very obvious reason. Women simply do not have as many candidates running for office as do men. If more females hope to gain seats in Congress, more must be willing to run campaigns. Womens participation in political education is also below that of mens. Many argue, however, that women are receiving appropriate education and are attempting to run for office. The reason they have difficulty in gaining seats is peoples predisposition to favor the traditional. Voters are used to males holding these positions, and therefore naturally favor a male candidate to a female . If women hope to achieve more success in their numbers in the government, the general voting population must be more willing to accept them as leaders and vital assets on Capitol Hill. This cannot be done by apathetically hoping people will come to their senses. Women have to make strong efforts to assert themselves in those positions, and show future voters their capability. Some feel traditional views and number of candidates are not the most important factors restricting women from gaining equal representation. The biggest obstacle facing women with regards to underrepresentation in Congress is not peoples tendency to favor males for these positions. Instead their lack of wealth is the primary reason men have over eighty percent of the seats. (Rochne) The number of men with the funding to undergo a costly campaign process is much more numerous than the small number of females who could afford to run. Those women with money who choose to run are still often overmatched when it c omes to funding. Fortunately, women are holding more assets, getting more degrees, and working at more high-level jobs than any other time in Americas history. Often it is not money that holds minorities back, but how the voting system is set up in our Country. Redistricting is essentially a political game in which people with the most influence are trying to see their views favored, whether thats to favor party or ethnic hopes. In reality, minority voters wouldà ¢Ã¢â€š ¬Ã‚ ¦ become submerged in white majority districts, and we would turn the clock back to a time when we had virtually all-white legislatures.(Amy) This is focusing on how redistricting can be instrumental to the racial layout of congress. For many years this was a large factor in the white majority, until it was brought to the courts. This is seen in the Supreme Court case Thornburg vs. Gingles of 1986. The court declared in a unanimous vote that the legacy of official discrimination acted in concert with the multimember districting scheme to impair the ability of cohesive groups of black voters to participa te equally in the political process and to elect candidates of their choice. Essentially this facilitated the creation of United States house districts in which a minority population constitutes a majority of the voting age population. (Banducci) Combined factors still affect minority representation. Wealth, education, experience, number of candidates all contribute to the underrepresentation of ethnicities. Despite all of these factors and the others unmentioned, districting is often considered the most challenging and restraining of all. The amount elected is solely reflected by the numbers of that minority in a voting district. (Peyton) Without minority voting populations being properly represented in their districts, they cannot be properly represented in the Federal Government. Some believe, however, that racial redistricting would have its down falls and is paradoxical in nature. As voting districts are altered to allow for racial minorities to gain election to seats, Congress may be less likely to side with this races ideology and the policies they hope to implement. For example if a district was drawn to favor African-American candidates, Congress may feel less inclined to adopt policies that are favored by many African-American voters. à ¢Ã¢â€š ¬Ã‚ ¦particularly in the South, the practice of concentrating minority populations into a small number of districts decreases the liberal influence in the remaining areas. Thus, a handful of minority representatives, almost invariably Democrats, win elections, but so do a greater number of conservative Republicans. (Lublin) Not only will Congress be less willing to accept their policies, but liberal influence in other districts will suffer as a large number of minorities vote democratic. This in turn does the op posite of what activists are hoping. While one minority may gain a seat, their party could lose two. It is still very hard to deny the lack of diversity in Congress. In the United States Senate there are currently no blacks holding positions. In fact, only 6 senators have been African-American since the beginning of the Senate. Todays Senate is made of a 96% white majority. Only 4 senators are racial minorities, Daniel Akaka, Hawaii (Asian-American, Daniel Inouye, Hawaii (Asian-American), Robert Menendez, New Jersey (Hispanic-American) and Marco Rubio, Florida (Hispanic-American). That means that Latinos make up 1% of the Senate, while the latest census found that they make up almost 17% of the United States entire population. It is clear why many are upset about the underrepresentation of minorities. When interviewed about this subject, it was found that most senators do not find this as a matter of importance. (Desjardins) Instead they believe the system gives an equal chance to a ll those running, and should be focused on merit not race. Senators feel that redistricting to aid the election of ethnic minorities is unfair and unnecessary. Of course their opinions are not at all objective; it shows the reluctance of the government when addressing these issues. Legislation is difficult to pass because the white majority would like to continue to see themselves as the majority. Even more than the election that made Barack Obama the first black president, the one that returned him to office sent an unmistakable signal that the hegemony of the straight white male in America is over. The long drive for broader social particip ation by all Americans reached a turning point in the 2012 election, which is likely to go down as a watershed in the nations social and political evolution and not just because in some states voters approved of same-sex marriage for the first time. (West) As shown by Los Angeles Times writer Paul West, a new evolution in politics is beginning. It is clear that obstacles are still very much present in the legislative branch, but the new wave of voters and the progress made elsewhere shows that these trend may become a new normal for the United States. Were not in the 50s any more, said William Frey, a Brookings Institution demographer. This election makes it clear that a single focus directed at white males, or at the white population in general, is not going to do it. And its not going to do it when the other party is focusing on energizing everybody else.(West) Barack Obamas success in gaining election has been an unprecedented win for minorities in government. But to ensure that his achievements have a lasting impression, minorities must take his work in stride and continue down the path to representation. Now more than ever people are straying away from views that the candidates need to fit a certain profile. Still work needs to be done. The cabinet is made up of almost entirely white males, and the Supreme Court is only just beginning to diversify. Despite the success seen in some areas of government, the two houses of Congress are far away from fair representation. The solutions to fixing this issue, however, are very difficult to identify and even more difficult to put in place. The first option is to allow things to continue on their own path, and hope that more minorities will be elected. (Amy) Some argue that this could potentially work based on trends that have been occurring since the mid 1900s. Minorities are gaining seats slowly, and soon more will become available to them. Although possible, this method would create a long process of representation that could take several decades to become fair. It also creates an opportunity for minorities to move backwards instead of forwards, pushing districts back to even more unfair sections. Activists agree that this is not a true option to solving the problem of underrepresentation. Another solution is one that is used today. Groups like the NAACP can fight each individual chal lenge that is placed on minority districts. (Amy) This is more of a short-term solution however. The Supreme Court will not vote in favor of challenges when the only reason in race. Legal groups that fight for these districts are only keeping a minimal hold on the districts necessary for minority representation. So while this effort to save current minority districts is an important short-term tactic, and while it may work in some cases, it is difficult to be optimistic about the long-term success of this approach. (Amy) It is clear that this issue cannot be resolved by numerous court cases defending districts, especially when the Supreme Court does not look favorably on challenges solely based on race. The solution that could potentially solve these issues is an alternative election system based of proportional representation. This system is used by several Western nations and has shown great success in equaling the number of minorities in government. There are two separate ways to do this: one is by a cumulative vote, the other is by creating multi-member districts. The cumulative vote has already been used in some states for local elections in the U.S., and has shown considerable success in getting more minorities into local government positions. The success of this method at lower levels could also indicate that a cumulative vote used in districts could help minorities gain a fair amount of congressional seats. Multi-member districts are another viable option. If a districts voting population is 20% Hispanic, then that district would have 5 members, one of them likely turning out to be Hispanic. Minorities tend to vote for candidates from the same ethnic background, so creating districts into multi-member could even the playing field and create much greater representation of ethnic minorities. In the long run, proportional representation may be the only politically and constitutionally viable solution to the problem of minority representation in the U.S. P R would allow minorities a fair chance to elect their own candidates without resorting to the kind of race-based districting that has provoked the recent legal backlash. White voters would have nothing to complain about with PR since it would allow them to elect their fair share of representatives, and it wouldnt involve the drawing of special or funny shaped districts to benefit minorities. In this sense, proportional representation is a truly race neutral approach to districting, and one that would finally resolve once and for all this festering political problem. Americans committed to fair representation need to familiarize themselves with how these alternative systems work, promote the adoption of these systems on the local level, and pressure Congress to pass legislation to allow the use of proportional representation for congressional elections. Now is not the time to abandon the goal of fair representation for all Americans. We simply have to find new ways to achieve that go al; and currently, switching to proportional representation elections would seem to be our best bet. (Amy) Although this seems like an effective option, it is very difficult to put in place. Most political scientists agree that districting is the source of the problem, but if something could be done it would have already happened. (McCray) Most members of Congress are white males and will not support any acts that would potentially hurt their chances for reelection. Racial minorities need to find other ways than tirelessly challenging through the courts, and hoping that something will change about districting. Funding and strengthening of merit are two things that must be focused on. Latinos, African-Americans, and women all need to increase their wealth and their resumes if they wish to appeal to a broader audience. The graph on the next page, provided by the census bureau, shows the large gap in wealth between the majority white and all minorities. Whites hold 22 times the amount of wealth that blacks do. (Luhby) This also correlates with the amount of education received by these ethnicities. Without more success as a minority in America, it will be difficult for them to hold seats in either the House of Representatives or the Senate. Having less wealth and home equity means it will be more difficult for blacks and Hispanics to send their children to college, which gives them a leg up on landing good jobs, said Roderick Harrison, senior research scientist at Howard University. That will further extend the wealth gap. The implications will be with us into the next generation, which will have greater difficulty in getting the kinds of jobs needed to start saving and building wealth, Harrison said. He molded his hacking style around the stupidity of humans and his quest for intellectual knowledge. Many of the jobs that Mitnick pulled exploited the ignorance of humans rather than the security software of the companies. Mitnick tries to warn corporations now that "There is no patch for stupidity." (Mitnick, 2003) We are getting to an era in life were humans are not smart enough to run the machines they created. During the beginning of the book, Remarque explains the boy's job, relating it to how hard it is to be in the war. What was going to happen, is described good by the way that the author talked about the life of the soldiers, but the boys failed to realize reality. Thinking that the war was just an ideal character. Convincing the reader to believe the boys didn't know the risk they were taking by being in this war. They way the boys viewed it, shows that, true their are some hard times in wars, but their minds are young and they thought it was just another thing to talk about. When they should have been taking things more serious, but thinking about the good parts helped them to keep a hold on their sanity. "They ought to have been mediators and guides to the world of maturity, the world of work, of duty, of culture, of progress to the future", was the beliefs of the boys after their friend Behn dies. Their generation thought that the authorities were going to look after, and take care of them, the authorities were thought of real highly by them. Until their friend passed away, then everything changed. Of Mice and men, Analysing weak characters Essay

The novel is called ‘Of mice & men’ because things can go wrong between a small mouse to an important human being. Thing can go wrong despite how hard you try. There are two characters in this novel that I think are portrayed as being weak. One of the characters that I feel comes across as weak in the novel is Crooks. The reason being is because of how he is treated by the other characters in this novel. For example, most of the characters except for Slim refer to Crooks as a ‘Nigger’. Even though ‘Nigger’ is a racist term, it was used normally in those days. But this shows the little respect the rest of the characters had for Crooks; they could have decided to refer to him using his real name, just like Slim. The fact that they continuously call him that shows the weakness in Crook, if he had the amount of free will and power the rest had, he would have spoke up and tell them to stop calling him a ‘Nigger’. Steinbeck may have set it out like this to show that not everyone was racist and disrespectful to whom the majority of the people thought was inferior. Slim could have been a character just like Steinbeck, he’s showing that he is not racist and is empathetic to Crook’s feelings, and is aware that despite his skin colour, he is just as superior. However, noticing this, Slim could be portrayed as weak because he didn’t speak up to defend Crooks when it came to the name calling, if he did, he probably would have been casted as a ‘Sell out’ by the other characters. There is another incident in the novel that shows how inferior and weak Crooks is portrayed. After Curley’s wife enters the room to talk to him, Lennie and Candy, Crook’s ends up getting frustrated with Curley’s wife and starts telling her off. However, by now the readers would have thought that Crook’s is finally standing up for himself and defending himself, but this all changes in the space of a few minutes. For example, Curley’s wife retaliates and say’s ‘Listen, Nigger, you know what I can do to you if you open your trap?’ ‘Well, keep your place Nigger. I could get you strung up on a tree so easily it ain’t even funny’. ‘Strung up on a tree’ meant to be lynched; this shows that she had the power to get Crooks lynched, even for the pettiest things. So even though Crooks was speaking the truth, him speaking up could get him into trouble, he can’t win, him staying quiet and saying the things the other characters wants to hear makes him look weak, but even when he does speak up against problems, he is still portrayed as weak. After Curley’s wife mentions this, the narration says ‘Crooks seemed to grow smaller’ the use of the letters ‘Er’ shows that he was already ‘small’ but by Curley’s wife mentioning Lynching, it made him ‘smaller’, weaker than he already is. One more factor that shows Crooks is weak, is by the structure of the chapter, the chapter starts and ends the same. On page 99, it say’s ‘Crooks sat on his bunk [†¦] he held a bottle of liniment and with the other hand, rubbed his spine’. The chapter also ends the same way. This shows that the way Crooks is living is never ending, it’s a cyclical feature, and there is no hope for him. Also, because Steinbeck kept on referring to his spine, shows that even though Crooks does have hopes and dreams, him being black and being injured is what’s stopping him from living the ‘American dream’. The injury to Crooks back occurred after being kicked in the spine by a horse. The reason for this is because of where Crooks Is forced to sleep. Crooks sleeps in a barn. This is usually a place where horses rest. On page 98, it lets the readers know the Crooks bun was made form a long box filled with straw. ‘Crooks’ bunk was a long box filled with straw’. This portrays him to be some sort of animal. He is portrayed as a horse. Again even though horses are strong physically, they are weak in the sense that they have no power, they are usually tied up. This is a good example of Crooks. Again, he may be the most intelligent out of the characters and in some ways, mentally strong. But he is still weak in other ways. Another character that Steinbeck portrays as being weak is Curley’s wife. The apostrophe in ‘Curley’s’ is possessive, this shows that Curley’s wife belongs to Curley and that he is her owner. She is referred to as ‘Curley’s wife’ throughout the novel and is not named. It also shows how unimportant she is and how little the characters think of her. Another way she is portrayed as weak is by her attitude towards the men in the novel. Curley doesn’t pay her much attention, so she feels insecure and lonely. This makes her want the attention of the other men and makes her feel superior and important, even though she isn’t. The characters talk about her in a negative way behind her back. For example, after Curley’s wife is introduced George say’s ‘Jesus, what a tramp’. The use of the word ‘Jesus’ makes Georges reaction the Curley’s wife seem dramatic, this shows that Curleyâ⠂¬â„¢s wife is a huge problem if she causes such dramatic responses. Also he refers to her as a tramp. ‘Tramp’ can mean many things, but one definition of a tramp for a female is a prostitute or a person regarded as promiscuous. This is Georges first impressions Of Curley’s Wife, and this is how she comes across whilst trying to flirt. This shows how weak she is to George especially. She may be trying to flirt and act sexy in order for the men to lust after her but her trying has no effect on George, he thinks of her as the opposite. George also calls her a ‘bitch’ and a ‘Rat trap’ whilst talking to Lennie. A ‘bitch’ is the name given for a female dog, this links to the apostrophe in ‘Curley’s wife’ Dogs are popular pets and have owners. She is like Curley’s pet. Curley’s wife thinks of Crooks, Lennie and Candy as the ‘Weak ones’ by her saying this, it makes her look weak as well, she feels she has to refer to them as something deemed inferior in order to make her feel superior. However, even though she refers to them as this, she still hangs around them, this show’s that she hasn’t got much choice and that that is the only form of company she has and appreciates, despite coming across as nasty. This shows her weak side. In section 5, Curley’s wife goes in the barn to comfort Lennie and flirt with him, this could have led into something more. If she didn’t end up dying she probably would have ended up sleeping with Lennie. This again, shows her weakness; she is not strong enough to just leave Curley if she is not happy, she married Curley for the wrong reasons, leading to her being unhappy. Instead she goes behind his back looking for ‘Love’, ‘comfort’ and a sense of ‘importance’. This leads to her being accidently killed by Lennie. Before this happens whilst she confides in Lennie she admits, ‘He says he was gonna put me in the movies’ referring to one of the actors she met. This didn’t end up happening so she ended up marrying Curley. She then goes on and says ‘So I married Curley. [†¦] I don’t like Curley, he ain’t a nice fella’. This shows that she had no choice but to marry him and that she is finding it hard to escape from him. The death of Curley’s wife is like Karma. She threatened to get Crooks lynched if he carried on disrespecting her but then ended up dying as a result of her neck of being broken, this is what lynching is. Also, she married Curley for the wrong reasons and used him and she was also the women who stopped the characters from living their dreams, this may have been out of spite from her not getting to live hers. However, again, she ended up dying, and the characters still didn’t get to live their dream. This is how Karma works, ‘what goes around comes around’. This could be linked to the ‘Cyclical feature’ in the novel, the problems are never ending and there is just no hope. To conclude, both Crooks and Curley’s wife are very much alike and they’re just as weak as each other. Both characters are referred to as harsh names other than their real names. They both had dreams of being successful but it never happened. Crooks is a black man, and Curley’s wife is a white women. So even though Crooks had dreams and was capable of getting far the only problem that would have been stopping him is the fact that he is black and racism was in full effect in those days. Also, he was the smartest among the other characters, this links back to the title ‘Of mice and men’ that things can go wrong despite how hard you try. So despite his intelligence and how hard he learns, he still can’t get to where he wants to go in life. Nevertheless, even though Curley’s wife is white, she is a woman. Women didn’t have that much say or rights when men were involved. So her dreams and goals were not reached. For example she say’s ‘I never got that letter, I always thought my ol’ lady stole it’ She is adamant that her mum stole the letter an actor ‘wrote’ to her, so that’s why she never became an actress. Except, going back to how powerful men were in those days, White American men especially, he may have not even written a letter, probably forgetting about her and just complimenting her because it was the heat of the moment type. This shows that Curley’s wife is not mentally strong enough to come to terms and face reality of what actually might have happened, again that’s her way of feeling important, because deep down she is a weak individual.

Edward Taylor was a pastor, physician and an American poet. He lived between 1642 and 1729; a time of devastating living conditions. At this time America was still a colony of Britain a fact that increased human problems (Jerrett, 384). Edward, as everyone else, lived in terror of his life and home being in danger. Yet, during these terrifying moments, he drafted poetry one of them being _A fig for thee oh! Death._ Being a strong believer of Christian faith, Edward was determined to ascertain his belief of life after death. Just like most of his poem, â€Å"_A fig for thee oh! Death†_ aimed at criticizing death. The analysis in the succeeding sections focuses on the poem in details paying special attention to his description and attitude towards death. In addition, an analysis is provided concerning Edward’s central message, which was firmly founded in his unending faith in God. The poem’s title insinuates that the main idea was basically focused on the death phenomenon. However, perhaps it is possible to derive a different meaning from the manner Taylor addresses the subject matter. In the poem, he vows vehemently his lack of confrontation to save his life, his body, from cruelty of passing away, for God protect his soul (Jerrett, 386). Accordingly, it can be concluded that Edward attempted to prove that there was notable disparity between soul and body. At the same time, he also shows his attempt to reconcile the huge gap between body and soul. From the start of the poem, the poet creates two edges that form a man, the human Saul and body, â€Å"_Kernel†¦..nut_† (Taylor 306). Death is embodied as a ghastly monster that is a man-eater, characterized by terrible â€Å"_Ghastly eyes†¦.bare bones_.† Its attempt to destroy human body does not scare Taylor. He adds that the  soul is safeguarded by the Almighty God â€Å"_its heavenly Kernel’s box abides most safe.†(Taylor_ 306). It can be noted that the speaker is eager to abandon the body and that is why he compares it to the body of a temptress, a hedonist. Thus the central idea of the poem swings from contemplation of natural death, to the mortal body which is portrayed as a liability to the speaker (Jerrett, 389). Moreover, the narrator looks at death as a savior, a weapon strong enough to conquer the evil. Indeed, he considered death the wiles and temptations of the body. Therefore, he suggests that it the monster should be welcomed as destroyer of human body and not the soul. In fact, he is fully confident that the only thing that prevents him from going to heaven and from realizing grace is the fresh (Jerrett, 391). The poet is also confident that disposal of the fresh through death will mark the beginning of the judgment day, † _Till she hath slept out quite her fatal sleep. When the last cock shall crow the last day in†¦_† (Taylor 307). Thereafter, the destroyed, imprisoned and ultimately faulty body will accompany the soul to heaven. Death changes from being a monster to a necessary element crucial in attaining grace of God. However, later on perspective of the speaker changes where he admonish death for killing the fresh so slowly thereby keeping the narrator from ascending to heaven. He says â€Å"_is this the worst thy terror then canst. Why then should this grimace at me terrify?†_(Taylor 307) The poem helped Taylor to resolve the scuffle of the soul and the body. He manages to illustrate how the human body can offer numerous temptations and still allow a person to go to heaven. The main message that Edward is putting across is that there is life after death. This can be developed similarly which have been mentioned above by the carers, parents, teachers, and people who all are associated with the children during this period. As is known that learning is a continuous process. So it is obvious that children start learn ing since they are born. Thus during this period, they need proper guidance which will help them in future to be a better human being. So communication and language in that sense remain the most important part of a child’s growth stage. (Whitehead, 2007, p.xv) so it needs to keep in mind that development in the early years is very vital part as it is the most delicate stage of children. They could be mold in every possible way which will guide them to build up their future. The purpose of this study is to understand and review the theory concerning early literacy development. The different areas of literacy development could be language, communication structure, writing and reading skills. (Many, 2009, p.171) the view of literacy practices of children in early years must be recognized in their own way rather than forcing them to do something follow any particular strategy forced by other (Bradford, 2009, p.14). A change model is used to propose changes in child literacy progr ams on the basis of the literature survey conducted. The literature search strategy which we will be using here is various sources from books, scholarly articles and other information from Ebsco website. Ebsco provides a database of various articles which can help to collect detail information about the subject. Thorough study on the literature review of various authors will give an idea about the discussion and how they have formulated the issues. Apart from this primary and secondary researches will be evaluated which will provide detailed information about the study. Primary researches conducted by researchers and the result which has been generated as per those researches will help to simplify the matter.
